If the company chooses to forgo the notice period, the employee may be required to pay an amount equivalent to the wages that would have accrued during the specified notice period. The term “wages” is broadly defined under the Employment Ordinance (EO) to encompass most cash allowances, excluding any gratuitous or discretionary payments by the employer. The EO outlines the minimum amount to be paid, and if the employment contract specifies a more generous payment, compliance with the contractual terms is necessary.
Taxation
The responsibility for declarations and implications arising of all personal income tax purposes lies solely with you.
Background Verification and Reference check
As part of our standard hiring procedure, SGR Software Solution Pvt Ltd will initiate a comprehensive background and reference check on your previous employment details. Within the next few days, you are requested to submit documents related to your education, previous employment, and any additional records that SGR Software Solution Pvt Ltd deems necessary for a thorough background assessment. Our authorized partner will contact you to carry out the background check, and your cooperation is essential to facilitate the process by providing relevant details or documents.
Please be informed that your formal employment with SGR Software Solution Pvt Ltd is subject to the receipt of a satisfactory report from the background check. This report will encompass aspects such as employment history, experience, and other relevant work-related details. The background check will be conducted by an agency approved by SGR Software Solution Pvt Ltd. Your prompt and complete cooperation in this matter is appreciated.
Performance and Salary
You will be eligible for semi-annual or quarterly Performance Reviews throughout the respective year. Your career advancement and salary revisions will be determined based on your performance and in accordance with the prevailing company policies at the time of evaluation.
Protection
The Employee shall indemnify the Employer against any liability arising directly from the Employee’s negligence, breach of contract, breach of duty, or breach of trust concerning the affairs of the Employer.
Absence
In the event of incapacity due to sickness or injury, the Employee must notify the HR Manager no later than [Time to report sick] on the first day of absence and provide a detailed explanation of the reasons for their absence.
If the absence is for four days or less, the Employee must complete a self-certification form for each day of absence upon returning to work.
For absences exceeding four days, the Employee must provide the Employer with a medical certificate from a General Practitioner on the fifth day of absence, stating the reason for the absence, and subsequently provide additional certificates for any further periods of absence.
Upon request, the Employee will undergo a medical examination by a registered medical practitioner nominated by the Employer at the expense of the Employer. Additionally, the Employee will provide blood, urine, or other specimens for analysis if requested.
Grievance
If the Employee has any grievances concerning their employment, they should address them with the HR Manager either verbally or in writing. For additional information regarding the grievance procedure relevant to this employment, the Employee should consult the Director.
Data Protection Act
The Employee hereby grants consent to the collection and processing of personal data provided by them to the Employer for all purposes related to this employment, including but not limited to administering and maintaining personnel records, processing salary and other remuneration and benefits, conducting performance appraisals and reviews, maintaining sickness and absence records, and making determinations regarding the Employee’s fitness for work.
Additionally, the Employee acknowledges and agrees that the Employer may, in the course of its responsibilities as an employer, be obligated to disclose personal data pertaining to them even after the termination of their employment.
Confidentiality
During and after the termination of their employment with the Employer, the Employee is prohibited from disclosing to any third party, except in the proper course of their employment, any confidential information pertaining to the Employer, the Employer’s customers, or suppliers. Furthermore, the Employee shall refrain from utilizing such confidential information in a manner that could directly or indirectly result in loss to the Employer. Confidential information encompasses, but is not limited to, financial details, commercial data, technical specifications, sales and marketing strategies, trade secrets, and proprietary application software not intended for sale to external parties.
Property
The Employee is obligated to review and adhere to the policy and regulations outlined by the Employer. Failure to comply may result in disciplinary measures and, in severe instances, termination. The Employer maintains a comprehensive IT, Communications, and Monitoring Policy, a copy of which is accessible through SGR Software Solution Pvt Ltd.
The Employee acknowledges that all files, customer records, lists, books, literature, software, products, and work products generated by the Employee during their tenure with the Employer, as well as other materials owned or utilized by the Employer in the course of its business operations, shall remain the exclusive property of the Employer at all times. Furthermore, upon request or termination of employment, regardless of the circumstances, the Employee agrees to return to the Employer all such files, records, literature, products, software, work products, and any related copies, as well as any other property belonging to the Employer. In the event of misuse of company assets, information, or engagement in external work without authorization, the company reserves the right to pursue legal action against the involved parties.
Commitment
As an employee working at SGR Software Solution Pvt Ltd, you are prohibited from associating, either directly or indirectly, with any other organization or forming any company that provides similar services. This commitment is in effect during the term of your employment with SGR Software Solution Pvt Ltd.
